NaturaLawn files complaint against Naturescape

NaturaLawn-of-Anmerica-logoNaturaLawn, a Maryland-based lawn care company with more than 70 franchises in the U.S., filed a complaint against Naturescape, a Wisconsin full-service landscape company, in the Northern District of Georgia, according to the National Law Review. The complaint alleged trademark infringement, false designation of origin and unfair competition.

The dispute comes after Naturescape filed an intent-to-use trademark application for the name Nature’sLawn, which NaturaLawn opposed during the opposition period. On March 1, NaturaLawn filed a motion to suspend the opposition due to the civil trial, which has not yet been granted.

Naturescape also opened lawn care services in the Atlanta area under the name Nature’sLawn, instead of its usual company name, Naturescape. NaturaLawn doesn’t currently offer services in Atlanta, but it has in the past and is in talks with potential franchisees to re-open in the area, according to the report.

Naturescape refused NaturaLawn’s request to cease using the name Nature’sLawn. NaturaLawn seeks an injunction, destruction of all of Naturescape’s advertising materials that bear the name Nature’sLawn, withdrawal of the Nature’sLawn application and attorney’s fees, according to the report.
